New York Securities Fraud
Lawyer
If your stock broker or a seller or issuer of
securities has taken you for a ride you don't want to be on, you
may be the victim of securities fraud. Securities fraud typically
occurs when people who invest in stocks or other securities are
enticed to part with their money based on untrue or deceptive
statements or practices.
Some of this country's largest, richest and most prominent corporations
have been accused of committing securities fraud. This conduct
is alleged to have resulted in tremendous losses to investors
and tremendous profits to the firms that committed the fraud.
Many cases alleging securities fraud are brought in federal court
while others are taken to arbitration rather than to court.
Some of the more common types of misconduct currently practiced
by stock brokers are:
Misrepresentations and Omissions - a stock broker fails to disclose
or misrepresents material facts or information regarding securities,
including any associated risks.
Unsuitability - a stock broker recommends or solicits transactions
or investment strategies that are not suitable for the customer
in the context of the customer's risk tolerance and financial
objectives.
Churning - when a stock broker who is exercising control over
trading activity in an account buys or sells a customer's securities
to an excessive degree, contrary to the customer's investment
objectives and risk tolerance, resulting in greater commissions
for the broker and losses for the customer.
Unauthorized Trades - when a stock broker trades in a customer's
account without obtaining prior approval of the trades.
Theft of Investment - a stock broker indicates that your money
has been invested when the broker has actually stolen it.
